13. WAIVER, RELEASE AND LIMITATION OF LIABILITY. YOU AGREE THAT NONE OF THE CHOICE MEDIA PARTIES SHALL HAVE ANY LIABILITY TO YOU UNDER ANY THEORY OF LIABILITY OR INDEMNITY IN CONNECTION WITH YOUR USE OF THE SITE. 14. Third Party Rights. The provisions of paragraphs 12 (Indemnification) and 13 (Waiver, Release and Limitation of Liability) are for the benefit of the V.C.B Enterprises Parties. Each of the V.C.B Enterprises Parties shall have the right to assert and enforce those provisions directly against you on its own behalf.

15. User Representations. You represent and warrant that you are at least 18 years of age and that you possess the legal right and ability to enter into this Agreement and to use the Site in accordance with this Agreement. You agree to be financially responsible for your use of the Site (as well as for use of your account by others (whether authorized or unauthorized), including use by any minors living with you) and to comply with your responsibilities and obligations as stated in this Agreement.

16. Miscellaneous. This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regarding provisions relating to conflicts of law. You agree that any legal action or proceeding between V.C.B Enterprises and you for any purpose concerning this Agreement or the parties' obligations under this Agreement shall be brought exclusively in a court of competent jurisdiction sitting in Arlington County, Virginia, United States, and by accessing the Site you consent to the personal jurisdiction of any state or federal court located in the Commonwealth of Virginia. Any cause of action or claim you may have with respect to the Site and/or this Agreement must be commenced within one (1) year after the claim or cause of action arises. This Agreement constitutes the entire Agreement between V.C.B Enterprises and you with respect to your access and use of the Site. Any failure by us to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. We may assign our rights and duties under this Agreement to any party at any time without notice to you.

17. Notice. We may deliver notice to you under this Agreement by means of electronic mail, a general notice on the Site, or by written communication delivered by first class U. S. mail to your address on record in your account information, if any.

1. Overview

V.C.B Enterprises, Inc. ("V.C.B Enterprises"), a Delaware corporation, is the owner and operator of this web site (the "Site").

Such contact information is used to contact the user when necessary. Users may also choose (opt-in) to receive future mailings (as further explained in the choice/opt-in section below).

B. Surveys and Questionnaires. Our online surveys and questionnaires may ask users for contact and demographic information. The user's contact information is used to contact the user when necessary. Users may opt-out of receiving future mailings (as further explained in the choice/opt-in section below).

C. Advertisers. We display advertisements on our sites that are provided by third parties. In some instances, users may request more information from these third parties concerning their respective products and/or services by clicking on such advertisement. Some of our third party advertisers offer to contact our users directly as a way to follow up a user's interest in its products and/or services. Other Information:

A. Demographics. We receive and store certain types of information whenever users interact with our Site. V.C.B Enterprises automatically receives and records information on our server logs from users' browser including IP addresses, V.C.B Enterprises cookie information, and the page requested.

Generally, our service automatically collects usage information, such as the numbers and frequency of visitors to our Site and its components, similar to TV ratings that indicate how many people watched a particular show. V.C.B Enterprises only uses this data in aggregate form, that is, as a statistical measure, and not in a manner that would identify a user personally. This type of aggregate data enables us to figure out how often users access parts of the Site so that we can make the Site appealing to as many users as possible, and improve the content. This information may be shared with advertisers and other third parties on an aggregated basis, but it does not indicate the identity of individual users.

B. IP Addresses. An IP address is a number automatically assigned to your computer whenever you access the Internet. All computer identification on the Internet is conducted with IP addresses, which allow computers and servers to recognize and communicate with each other. Through the Site, we collect IP addresses in order to conduct system administration, report aggregate information to sponsors and advertisers, and to conduct Site analysis. Advertising Policy

Health-Square has sole discretion for determining the types of Advertising and Promotion that will be accepted and displayed on the Health-Square Site. Health-Square will not accept Advertising that, in our opinion, is not factually accurate and in good taste. It is the responsibility of the Advertiser to comply with all applicable domestic and foreign laws, including applicable laws and regulations relating to  Direct to Consumer (DTC) advertising. Health-Square will not monitor compliance with applicable laws and regulations.

Health-Square recognizes and maintains a distinct separation between Advertising content and editorial and decision-making content. All Advertising content on the Health-Square Site shall be clearly and unambiguously identified as such. Content which is provided / sponsored by advertisers will be clearly identified as SPONSORED.  

Health-Square retains the exclusive right to determine the way in which any and all search results for specific information by keyword or topic are displayed on the Health-Square Site. Health-Square may display search results based on monetary incentives provided by Advertisers.

Under no circumstances shall Health-Square's acceptance of any Advertisement be considered an endorsement of the product(s) and/or service(s) advertised or for the company that manufactures, distributes, or promotes such product(s) or service(s).
